Trademark renewal & restoration in India

A trademark is the only IP right that can last forever, provided someone remembers the calendar. Renewals, late renewals with surcharge, and restorations of marks that slipped: filed properly, on fixed fees.

The short version: registrations last 10 years from filing and renew indefinitely on Form TM-R. Renewal opens in the final year; a 6-month grace period with surcharge follows expiry; after that, restoration is possible up to one year from expiry. Government fee indicatively ₹9,000 per class (verify at ipindia.gov.in).

Why lapsed marks are a genuine emergency

A removed mark is an invitation. Competitors watch the register; the moment your protection lapses, an identical or near-identical application can be filed, and now you are the one fighting an opposition over your own name. Restoration exists, but it is discretionary and slower than simply renewing on time. If your certificate’s date is within the last decade and you can’t remember renewing, check today.

When should I renew my trademark?

A registration runs 10 years from the filing date and can be renewed in the year before expiry. The Registry issues a reminder notice, but responsibility, and the consequence of missing it, sits with the owner. We diarise client marks so the window never slips.

What if my trademark has already expired?

Two safety nets. Within 6 months after expiry you can still renew with a surcharge. After that, and up to one year from expiry, you must apply for restoration, costlier, discretionary, and with the mark vulnerable in the interim. Past a year, you’re usually looking at filing afresh, with none of your old priority.

What is the government fee for renewal?

Indicatively ₹9,000 per class for e-filing of Form TM-R, with additional amounts where surcharge or restoration applies, fees are set by the Registry and change, so verify at ipindia.gov.in. Our fixed professional fee is quoted on top, separately.

Can my registration be cancelled even if I renew?

Yes, renewal keeps the registration alive, but a mark unused for a continuous period of 5 years and 3 months can be removed on a non-use application by a third party. Renewal is necessary, genuine use is what makes the right durable.
