What are trademark classes?

The Nice Classification divides all goods and services into 45 classes, 34 for goods, 11 for services. Your registration protects your mark only in the classes you file, which is why the same name can be registered by a clothing brand in Class 25 and a software company in Class 42 without conflict.

How many classes should I file in?

The classes you genuinely trade in now, plus any you’ll credibly enter soon. Products businesses very often pair their product class with Class 35 to cover their retail and e-commerce activity. Since government fees are per class, this is a budget decision too, we’ll tell you honestly which classes earn their fee.

What happens if I choose the wrong class?

A registration in the wrong class protects the wrong thing, competitors in your real category can register the very same name. Classes can’t be swapped after filing; the fix is a fresh application. It’s the most common self-filing mistake we’re asked to repair.
