™ vs ® vs SM: what you can legally use, and when

Three symbols, three very different legal meanings, and one genuine criminal provision hiding among them.

™, the claim

™ announces that you treat the mark as yours. It requires no registration, no application, no permission: you can append it to an unregistered brand today, and most businesses add it the day their application is filed. It creates no new rights by itself, it signals your claim and puts copycats on notice that you’ll assert whatever rights you have.

SM, the service-industry cousin

SM is ™ for services rather than goods, common in the US, rare in India, where ™ is used for both without controversy. If you like it for a consultancy or a clinic, use it; legally it behaves exactly like ™.

®, the earned one

® means registered, the mark is actually on the register. Here’s the tooth: Section 107 of the Trade Marks Act, 1999 makes it an offence to represent an unregistered mark as registered, with penalties that can include imprisonment. “Applied for” is not “registered”; the day your certificate issues is the day ® becomes yours. Not before, not on the packaging you’re printing “in advance”.

The practical etiquette

Unregistered or freshly filed: use ™. Registered: switch to ®, and use it, it deters copycats and reminds the market the name is property. Registered in India but selling abroad: remember rights are territorial; ® on export packaging should be true in the destination market too, which is a conversation about international filing worth having early.
