How to do a trademark search in India before you file

Every avoidable trademark disaster begins the same way: somebody skipped the search. Here is the routine we’d suggest to any founder willing to spend thirty careful minutes before falling in love with a name.

Step 1, the wordmark search

Open the public search on the IP India portal and select the wordmark mode. Run your name with “Start With”, then again with “Contains”, in the class your business belongs to (unsure? use our class finder first). Now repeat with the obvious mutations, swapped vowels, doubled letters, the Hinglish spelling, the version with and without spaces. Examiners search this way; so should you.

Step 2, the phonetic search

Switch to phonetic mode and run the name again. This is the mode that catches “Ziara” against “Xiara” and “Kwality” against “Quality”, sound-alikes are the most common ground for Section 11 citations, and spelling creativity has never once impressed the Registry.

Step 3, the device (Vienna) search, if you have a logo

Logos are indexed by Vienna codes describing their visual elements, a lion, a leaf, a monogram in a circle. Identify your logo’s elements, find their codes, and search the class. It’s clunky and worth it: device conflicts blindside applicants precisely because nobody looks.

Step 4, leave the register

India protects genuine prior users even without registration. So check the MCA name index for companies and LLPs, the obvious domains, Amazon and Flipkart, Instagram handles, and the app stores. A thriving unregistered brand can oppose your application or maintain a passing-off action, the register is necessary, not sufficient.

Step 5, judge what you found honestly

Finding something similar is normal. The questions that matter: is the earlier mark alive or abandoned? Are the goods actually similar, or just neighbours? Is the shared element distinctive, or is it “Royal”, “Shree” or “India”, which everyone shares? This weighing is where self-searches wobble, people either panic at noise or wave through real conflicts. When the stakes justify it, a professional comprehensive search with a written opinion settles the question for a fixed fee, in writing, before the filing fee is spent.
