Amazon Brand Registry & trademarks: what Indian sellers need

Every serious Amazon seller eventually meets the same wall: hijacked listings, copycat packaging, no A+ content, and the discovery that the fix, Brand Registry, wants a trademark.

What Brand Registry requires

Enrolment is built around a trademark, and Amazon has generally accepted pending applications, not only granted registrations, for eligible marks (text or image marks matching the brand on your products; requirements evolve, so check Amazon’s current criteria when you apply). Practically: the day your TM-A is filed and you hold an application number is the day your Brand Registry path opens, one more reason filing early beats filing perfectly.

What enrolment actually unlocks

Proactive protections that suppress copycat listings, tools to report infringement with teeth, A+ content, Stores, sponsored-brand advertising, and analytics, in short, the difference between owning your shelf and squatting on it. Flipkart’s brand programmes run on the same logic: the platform trusts sellers who can prove the brand is theirs, and the proof is the trademark.

Which class to file

Your product’s class first, 25 for apparel, 3 for beauty, 21 for kitchenware, 30 for foods (the class finder will place you), typically paired with Class 35 covering your retail and e-commerce activity. Sellers who file only 35 discover, at enforcement time, that they protected the shop but not the goods.

The sequence that works

1. Search, marketplaces are exactly where prior unregistered users live, so this scan matters doubly for sellers.
2. File TM-A in the product class(es) + 35; concessional ₹4,500 fee if you hold Udyam or DPIIT recognition (indicative, verify at ipindia.gov.in).
3. Enrol in Brand Registry with the application number once it’s accepted into Amazon’s system.
